1. Unconditional Agreement – Access to and/or use of the Northscaping web site will constitute your unconditional agreement to the following terms and conditions of use. If you do not agree with these terms and conditions, do not access or otherwise use this web site.

2. Control of Content – Users are expected to use this web site for lawful purposes only. Northscaping reserves the right, but not the obligation, to monitor, edit and otherwise control all content and information provided or published on the site by users or third parties. We reserve the right to refuse to post or to remove any postings, content, material or information which we determine to be objectionable, undesirable, fraudulent or slanderous, or otherwise in violation of Northscaping standards, at our sole discretion and without recourse.

3. Policies Subject to Change – We reserve the right to change, modify, add or remove any or all parts of the following agreements, at our sole discretion and time of choosing. All policy changes will be made on this web page, with no additional obligation for notification.

Privacy Policy

Northscaping is a community web site built for and by you, our community members. We want you to feel safe and comfortable in the Northscaping community, without worrying that your participation in Northscaping will compromise your personal information. That is why we want to be clear about our Personal Privacy Policy, as stated below.

1. Confidentiality of Information – Specific Northscaping pages permit you to enter contests, submit photographs, list your business in locator tools, or participate in on-line polls or discussion forums. Personal information may be gathered at these pages based on information you have provided. This information will remain private and confidential with Northscaping unless;

a) you explicitly authorize us to publish it or otherwise use it in a specified manner to which you have consented, or;

b) the specific use and/or disclosure of this information is made known and/or available to you prior to your submitting it to us.

2. Use of Information – When we use your personal information on the Northscaping site for explicit purposes, e.g. contest winners, etc., we will only publish any or all of your name and title, city/town, state/province and hardiness zone, and web site URL for “Your Web Sites”. However, where users voluntarily submit information where it is intended to be displayed in its entirety (e.g. business locator tools), the information will be used as indicated.

It is understood that;

- when you submit your name and location for a contest, or;
- when you provide information in a message board forum or within the content of a message, or;
- when you submit your business name and information to the various locator tools, or;
- when you submit photographs to the community photo album;

by submitting such information, you implicitly give Northscaping your consent to use the information as prescribed.

You have the right to indicate to us in your correspondence that you do not wish for any or all of the above information to be published on the web, and we will unconditionally respect that right. However, this may disqualify you from participation in certain Northscaping activities such as contests, features, showcases, on-line listings (e.g. “Your Web Sites”, “Photo Album”), etc., at our discretion.

3. Third Parties – We absolutely do not collect personal names, addresses, e-mails or any other personal information from your use of our web site or correspondence with Northscaping for sale or distribution to any third parties, whether authorized by you or not.

There may be cases where unauthorized third parties can gain access to some of your personal information through legitimate means by perusing our web site. For example, outsiders can clearly gain access to your business information from the “Business Locators” section, or can get your e-mail address if you decide to post it in a discussion forum. These unauthorized uses of your accessible information are beyond our control, and we cannot accept any liability for them. Please use your own judgment when making the decision to have us publish such information.

4. Solicitation – Northscaping will not directly solicit you by contacting you, unless you have authorized us to, either explicitly or implicitly through your participation in specific features (i.e. contacting a contest winner). We will not offer you unsolicited products, services or programs without your consent. We make our money from legitimate advertising and business promotional tools on the web site, not by directly soliciting our general audience.

5. Linked Sites – Some Northscaping pages contain links to other sites for which we have no control over their privacy policies. Visitors to those sites are advised to consult their respective privacy policies.

6. Legal Disclosure – Where required by a legal action, we may disclose personal information as required.
